1. Acceptance of these terms

These Terms of Service (“Terms”) govern your use of gohbs.com (the “Site”), operated by Health Benefit Strategies, LLC (“HBS,” “we,” “us,” or “our”), a Utah limited liability company. By using the Site, including the savings calculator and scheduling tools, you agree to these Terms. If you do not agree, please do not use the Site.

2. Informational purposes only

The Site and its content are provided for general informational purposes. Nothing on the Site constitutes medical, legal, tax, accounting, or investment advice. Content about ERISA, fiduciary duties, the Consolidated Appropriations Act, SIMERPs, or tax treatment is general in nature and should not be relied on as advice for your specific situation. Consult your own legal, tax, and benefits advisors before making decisions about your health plan.

3. Savings calculator and estimates

The savings calculator produces estimates based on the figures you enter, publicly available benchmarks (such as KFF survey data), and general program assumptions. Estimates are illustrative only and are not a quote, guarantee, or promise of specific savings. Actual results depend on your plan design, workforce, utilization, payroll structure, and applicable law, and can only be determined through a formal engagement.

4. No client relationship

Using the Site, running the calculator, or scheduling a discovery call does not create a client, advisory, or fiduciary relationship with HBS. A relationship is formed only through a signed written agreement.

5. Intellectual property

The Site and its content — including text, graphics, logos, and the calculator — are owned by HBS or its licensors and are protected by copyright and other intellectual property laws. You may view and print pages for your own business evaluation purposes. You may not copy, republish, scrape, or use the content for commercial purposes without our written permission.

6. Acceptable use

You agree not to misuse the Site, including by:

• Attempting to gain unauthorized access to the Site or its systems.
• Submitting false or misleading information through our forms.
• Interfering with the Site's operation or availability.
• Using the Site in violation of any applicable law.

7. Third-party services

The Site uses third-party services such as Calendly (scheduling) and Google Analytics (site measurement), and may link to other websites. Those services are governed by their own terms and privacy policies, and we are not responsible for their content or practices.

8. Disclaimer of warranties

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the fullest extent permitted by law, HBS and its members, managers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify and hold HBS harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Site will be brought exclusively in the state or federal courts located in Utah, and you consent to their jurisdiction.

12. Changes to these terms

We may update these Terms from time to time. Changes take effect when posted to this page, and the effective date above will be updated. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

13. Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, are the entire agreement between you and HBS regarding use of the Site.
